These General Terms and Conditions govern the contractual relationship between TORNO LIVING, S.L. and the persons making a reservation at any CASA TORNO accommodation.
The applicable conditions shall be those accepted at the time the reservation is made and shall form an integral part of the accommodation agreement.
The accommodation agreement, these General Terms and Conditions, and the house rules and rules of conduct available at the accommodation, including the rules displayed in the kitchen or any other visible area of the accommodation, shall together constitute the conditions governing its use.
The house rules and rules of conduct available at the accommodation shall be complementary and mandatory throughout the stay.
The lead guest agrees to inform all other occupants of the applicable rules during the stay and to ensure, insofar as reasonably possible, that they comply with them.
Making a reservation, accessing the accommodation and/or staying at the property constitutes acceptance of these conditions by the guest and all persons included in their reservation.
CASA TORNO provides tourist accommodation together with guest assistance and support services during the stay.
The services included and their conditions are detailed in Annex I – Services, which forms an integral part of these General Terms and Conditions.
A reservation shall be considered confirmed once the guest receives the corresponding confirmation from CASA TORNO or from the booking channel used.
The price, taxes, payment method and other financial conditions shall be those indicated during the booking process and in the booking confirmation.
CASA TORNO may require a €300 security deposit, which shall be communicated to the guest during the booking process and/or before access to the accommodation.
The security deposit is a guarantee and does not constitute an additional payment for the stay.
The security deposit may be used, in whole or in part, to cover amounts arising from:
The security deposit shall be returned after the stay and once the necessary checks have been carried out on the condition of the accommodation, with only the applicable and duly justified amounts being deducted.
Where any amount is retained from the security deposit, CASA TORNO shall inform the guest of the reason and amount concerned.
If the damage, expenses or costs incurred exceed the amount of the security deposit, CASA TORNO may claim the difference from the guest where legally applicable.
TORNO LIVING, S.L. shall issue the corresponding invoice in accordance with applicable tax regulations.
Each reservation shall be subject to the cancellation and modification policy indicated and accepted at the time of booking.
Where a reservation is made through an intermediary platform, the conditions applicable to the selected rate and booking channel shall apply.
Any modification to the dates, accommodation, number of guests or other booking details shall be subject to availability and may result in a change to the price.
All guests must provide the information and documentation required by applicable law for guest registration purposes.
CASA TORNO may require the registration process to be completed before providing access to the accommodation.
Failure to provide the required identification or the provision of false or incomplete information may prevent access to or continuation of the stay, to the extent permitted by applicable law.
The lead guest must be at least 25 years old, except for family bookings involving minors under their care or where expressly authorised by CASA TORNO.
The maximum authorised occupancy of each accommodation must be respected at all times.
Only persons included and registered in the reservation may stay overnight at the accommodation.
It is not permitted to accommodate, allow overnight stays by, or provide access to the accommodation to persons who are not part of the reservation without CASA TORNO's prior express authorisation.
External visitors must obtain prior authorisation from CASA TORNO before accessing the accommodation.
Under no circumstances may the accommodation be used by more people than its maximum authorised capacity.
The lead guest shall be responsible for the conduct of all persons accessing the accommodation with their authorisation or under their reservation.
The presence of unregistered persons, exceeding the maximum occupancy or using the accommodation by a number of persons greater than the number booked may be considered a serious breach of the accommodation conditions.
Where an unregistered person accesses or stays at the accommodation without authorisation, a charge of €200 per person per night may apply, in addition to any other measures applicable under these terms and conditions and applicable law.
The standard check-in time is from 3:00 PM onwards, and check-out is by 11:00 AM, unless another time has been expressly agreed.
Access before 3:00 PM or remaining at the accommodation after 11:00 AM is only permitted when previously and expressly authorised by CASA TORNO.
Where availability and operational circumstances allow, CASA TORNO may authorise early check-in or late check-out as a courtesy, upon request.
Access to the property is provided through electronic systems and personal, temporary and non-transferable access codes.
Access codes, keys, cards or access devices may not be shared with persons who are not included in the reservation.
Guests must respect neighbours, other guests, staff and the property.
The accommodation is intended for peaceful accommodation, relaxation and enjoyment by guests.
The organisation or holding of any type of party, event or celebration at the accommodation is strictly prohibited, both inside the accommodation and in patios, terraces, rooftops, galleries or other areas associated with the accommodation.
This prohibition applies 24 hours a day, 7 days a week, and not only during nighttime hours.
The prohibition includes, among others:
A gathering may be considered contrary to this condition even where there is no loud music or excessive noise, if its characteristics, number of people, purpose or behaviour give it the nature of a party or event.
This prohibition also applies where the gathering consists exclusively of persons included in the reservation.
Music, televisions, speakers, sound systems, musical instruments or any other devices may not be used at a volume that may be audible or disturbing to neighbours or cause disturbance in common areas or outside the accommodation.
This obligation applies 24 hours a day.
In particular, speakers, sound systems or similar devices may not be used to create a party atmosphere or play music at a high volume.
Quiet hours are from 10:00 PM to 8:00 AM.
During this period, particular care must be taken to respect the neighbours' right to rest.
No noisy activities, gatherings causing disturbances, shouting, loud conversations, music audible from other properties, dragging of furniture, noisy games or similar activities are permitted during these hours.
These obligations also apply to patios, terraces, galleries, rooftops and any other outdoor or common areas associated with the accommodation.
The fact that an activity takes place with doors or windows closed does not exempt guests from complying with these rules if the noise can be heard outside or causes disturbance.
The obligation to respect neighbours and avoid disturbances applies 24 hours a day.
The above rules are essential conditions of the accommodation service.
A single serious incident may be sufficient to constitute a serious breach, without the need for prior repetition.
Where a party, unauthorised event, disruptive gathering, excessive noise, serious breach of the rules of conduct or any other behaviour that may affect the rest of third parties occurs, CASA TORNO may immediately require the guest to stop the behaviour and take the necessary steps to restore peaceful coexistence.
Where the breach is serious or continues, CASA TORNO may take the measures provided for under applicable law, including the early termination of the stay and requiring the guest to vacate the accommodation where legally permitted.
Where necessary to protect people, property, neighbours or the facilities, CASA TORNO may request the intervention of the relevant law enforcement authorities.
Guests must use the accommodation, its facilities and equipment responsibly.
Guests must keep the accommodation in a reasonable state of order and cleanliness, close doors and windows when leaving, turn off the air conditioning when leaving the apartment and report any breakdown, damage or incident as soon as it is detected.
Guests may not tamper with electrical, plumbing, air-conditioning, telecommunications, security or access systems.
Certain areas of the building are reserved exclusively for CASA TORNO and its staff.
Guests are not permitted to access storage rooms, service areas, technical rooms, maintenance areas or any other areas marked as restricted.
Products, supplies, equipment, tools and materials stored in these areas are for the exclusive use of CASA TORNO and may not be removed, used or handled by guests.
Waste must be removed regularly and disposed of in the locations indicated by CASA TORNO. Waste must not be left or accumulated inside the apartments or in common areas.
Activities that may cause disturbance, damage, risks to people or property, or use of the accommodation for purposes other than normal residential and tourist accommodation are not permitted.
Smoking is prohibited inside the apartments and in the indoor common areas of the building, including the use of electronic cigarettes and vaping devices.
If smoking occurs inside the accommodation, a €200 charge will apply for extraordinary cleaning and odour removal.
This charge does not limit the possibility of claiming any additional properly evidenced costs where applicable.
PETS AND COMPANION ANIMALS ARE NOT PERMITTED IN ANY CASA TORNO ACCOMMODATION.
This prohibition applies throughout the entire stay and to any animal, regardless of size, species or breed.
Guests may not bring, accommodate, keep or allow companion animals in the accommodation, even for a few hours or temporarily.
This prohibition also applies to patios, terraces, rooftops, galleries and other areas associated with the accommodation.
Simply informing the host that a guest intends to travel with a pet does not constitute authorisation.
Individual authorisations for the introduction of pets or companion animals will not be granted, except in circumstances where access is legally required.
Breach of this condition shall constitute a breach of the accommodation conditions and may result in an immediate requirement to remove the animal and, where legally applicable, the early termination of the stay.
The introduction of an unauthorised pet shall result in a €200 charge for extraordinary cleaning and allergen treatment, without prejudice to any additional costs that may be duly evidenced.
The lead guest shall be responsible for damage, loss or breakage caused by them, the other occupants included in the reservation or their visitors.
This responsibility may include, where applicable, damage caused as a result of parties, events, excessive occupancy, unauthorised visitors, pets or animals introduced in breach of these conditions, negligent behaviour or any improper use of the accommodation.
CASA TORNO may claim reasonable repair, replacement or extraordinary cleaning costs, as well as losses directly resulting from damage caused, where such costs can be evidenced.
Extraordinary cleaning may include, among other circumstances, the removal of dirt, stains, odours, food or drink residues, waste, damage caused by animals, smoke, vomit or other consequences resulting from abnormal use of the accommodation.
Where a security deposit exists, it may be used in whole or in part to cover these amounts. Any retention shall be justified and communicated to the guest.
If the damage or costs exceed the amount of the security deposit, the difference may be claimed.
Guests are responsible for the safekeeping of their belongings during the stay.
Guests are advised to keep doors and windows closed and to securely store money, documents, electronic devices, jewellery and other valuables, particularly before cleaning services.
CASA TORNO is not responsible for lost, forgotten, misplaced or stolen belongings, without prejudice to any liability that may legally apply to TORNO LIVING, S.L.
Guests must report any breakdown or incident as soon as possible.
CASA TORNO staff or authorised personnel may access the accommodation to provide previously arranged services, carry out repairs or maintenance, or deal with incidents.
Whenever possible, the guest will be informed in advance.
In emergency situations or where there is a risk to people or property, access to the accommodation may take place without prior notice where necessary.
Certain common areas and entrances to the building are equipped with video surveillance systems for security purposes.
There are no cameras inside the apartments or in private areas.
Images shall be processed in accordance with applicable data protection legislation and the specific information available at the property and in the CASA TORNO Privacy Policy.
Compliance with these General Terms and Conditions, the accommodation agreement and the house rules and rules of conduct available at the accommodation constitutes an essential condition of the stay.
A serious or repeated breach of these General Terms and Conditions may result in the early termination of the stay where legally applicable.
The following shall be considered particularly serious breaches, among others:
In the above circumstances, CASA TORNO may require the behaviour to cease immediately and, where legally applicable, require the guest to vacate the accommodation.
Where applicable law permits the guest to be required to vacate the accommodation due to a breach of their obligations, the applicable statutory period shall apply.
Early termination of the stay due to a breach attributable to the guest shall be without prejudice to any amounts that may be payable under applicable law and the booking conditions for damage, expenses, extraordinary cleaning or other evidenced losses.
CASA TORNO may claim damages and losses caused and, where necessary, request the intervention of the competent authorities.
TORNO LIVING, S.L. shall be responsible for the provision of the accommodation service in accordance with applicable law.
It shall not be liable for interruptions or losses arising from circumstances beyond its reasonable control, such as general interruptions to utilities or telecommunications, weather events, actions by third parties, decisions by public authorities, force majeure or unforeseen breakdowns not attributable to the company.
Nothing in these conditions shall limit any rights legally available to guests as consumers or users.
The accommodation is intended exclusively for temporary tourist use during the booked period.
The stay does not grant any right to habitual residence, registration at the property, permanent occupation or any rights other than those arising from the accommodation booked.
Personal data will be processed by TORNO LIVING, S.L. for the purpose of managing bookings and stays, complying with legal obligations, managing payments and invoicing, handling enquiries and incidents, and ensuring the security of the property.
Full information regarding the processing of personal data and the exercise of data protection rights is available in the CASA TORNO Privacy Policy.
These General Terms and Conditions are governed by Spanish law.
Guests have access to the Official Complaints Forms provided by the Government of Andalusia in accordance with applicable regulations.
Any dispute shall be submitted to the courts and tribunals having jurisdiction under applicable law and, where the guest is a consumer, in accordance with consumer protection legislation.
TORNO LIVING, S.L. may update these conditions for legal, technical or operational reasons. Such changes shall not affect reservations already made, except where required by law.
The version applicable to each reservation shall be the version accepted by the guest at the time of booking.
At Casa Torno, in addition to accommodation, we provide services designed to ensure the assistance, comfort and support of our guests throughout their stay.
Upon arrival, the apartments also include an initial supply of coffee and products for use with the dishwasher and washing machine.
The above services are included in the accommodation price under the conditions and frequency indicated. Guests may request additional cleaning services or changes of bed linen and towels, subject to availability and at an additional cost.
Casa Torno offers laundry and ironing services upon request and at an additional cost.
